Lex Mercatoria and international contracts

Globalization affects virtually every aspect of human life. The contracts, traditionally responsible for ensuring predictability and stability in the legal relations between individuals, have been particularly affected by this phenomenon. One of the most visible aspects of this is the design of Lex mercatoria as an order built on customary practices and guided by particular principles. Despite the benefits of internationalization in ensuring stable trade relations, it is essential that the states continue exerting some sort of control over these relationships. The notion of internal public order, in that way, is useful to allow that the most fundamental aspects of national legal systems are preserved regardless of the law applicable to the contract. Bruno Fernandes Dias translated article written by Alexandre Sales Arlota Cabral, a professor of civil law and private international law of the Universidade Federal do Rio de Janeiro, on the subject. The translation was published in the Revista da Faculdade de Direito da UERJ.
